Most coverage of the peptide story skips the part where somebody explains what a peptide actually is. It is worth two minutes, because a single number in the federal code explains most of the regulatory map.
Start with the chemistry
Amino acids are the building blocks your body uses to assemble everything from muscle to hormones. String a few together and you have a peptide. String a lot together and fold them up and you have a protein. There is no natural dividing line between the two. Chemically it is one continuum, from a chain of two to a chain of thousands.
Peptides in the body generally work as signals rather than as structures. They bind to a receptor, and that binding tells a cell to start or stop doing something it already knows how to do. That is the mechanism. What any specific peptide does in a human being is a separate question, and for the peptides in the current compounding review it is a question the FDA has not answered.
Where the law puts the line
Because chemistry offers no dividing line, regulators drew one. Under 21 CFR 600.3, a "protein" is an amino acid polymer with a specific, defined sequence greater than 40 amino acids. The FDA settled on 40 after reviewing the scientific literature and its own practice, and explained its reasoning in the guidance accompanying the rule (FDA, Definition of the Term "Biological Product").
Land at 40 or fewer and you are a peptide, regulated as a drug. Land above 40 and you are a protein, regulated as a biologic under a different statute entirely.
That is why the substances at the center of the Section 503A review are all short. BPC-157 is 15 amino acids. KPV is three. Insulin, at 51 across two chains, moved to the biologics pathway in 2020 and has never been part of this conversation. The compounding fight is a fight about small molecules by regulatory definition, not a fight about biologics.
What the line does not tell you
Here is the part worth carrying: the 40-amino-acid rule is a filing category, not a safety statement. It tells you which office reviews a substance. It tells you nothing about what is in a particular vial.
That is decided entirely by who made it, under what conditions, and whether anyone independent tested it. On the grey market the honest answer is usually that nobody did, which is why a purity number on an anonymous label means very little (see our piece on what 99 percent pure actually means). A legal, tested pathway with a named pharmacy on the label is how that ends. That is the outcome Peppies argues for, and we say so plainly.
